01Who we are
American Proud of Patriots (“we,” “us,” “our”) is a sole proprietorship, selling American flags, drinkware, hats and related memorabilia. This policy covers americanpeople.live and the email, phone and order communications we conduct with customers. We are the controller of the personal information described here. Contact details are in section 17.
02Information we collect
Information you give us
- Contact details. Your name, email address, postal address and phone number.
- Order details. The items and quantities you order, shipping and billing addresses, delivery instructions and any gift message.
- Correspondence. The content of emails, voicemails and messages you send us, including questions, returns and bulk-order enquiries.
- Returns and support information. Details of a problem with an order, and photographs if you choose to send them.
Information collected automatically
- Device and usage data. IP address, browser type and version, operating system, referring page, pages viewed and the dates and times of those visits.
- Cookies and similar identifiers. As described in section 5. Items you add to the shopping cart are held in your browser's memory for the length of your visit and are not sent to us until you check out.
Information from others
- Payment processors. Confirmation that a payment succeeded or failed, the last four digits of the card, and the billing name and address.
- Shipping carriers. Tracking status and delivery confirmation.
- Advertising platforms. Aggregated, non-identifying reports on how our ads performed. If you contact us through a social platform, we receive the profile information that platform makes available, such as your display name.
We do not knowingly collect sensitive personal information such as government identification numbers, health information, precise geolocation, biometric data, or information about religious or political affiliations, and we ask that you do not send it to us.
03How we use information
- To prepare quotes and invoices, take payment, and fulfil and ship your order.
- To communicate about an order, return, refund or question.
- To provide customer support and resolve problems with products or deliveries.
- To keep records required for tax, accounting and business purposes.
- To operate, secure, maintain and improve this website.
- To measure and improve our advertising, including on social media platforms.
- To send occasional emails about new products or restocks, where you asked to receive them.
- To detect and prevent fraud, abuse and unlawful activity, and to enforce our terms.
- To comply with legal obligations and to establish, exercise or defend legal claims.
We do not sell your personal information, and we do not share it with third parties for their own independent marketing purposes.
04Legal bases for processing
Where the law requires a legal basis we rely on: performance of a contract with you, for order handling and delivery; our legitimate interests, for site security, fraud prevention, customer support and advertising measurement; your consent, for optional cookies and marketing emails, which you may withdraw at any time; and compliance with a legal obligation, for tax and record-keeping.
05Cookies and similar technologies
A cookie is a small file stored on your device by your browser. We use a limited number:
- Strictly necessary cookies keep the site working and secure. These cannot be switched off through the site.
- Analytics cookies help us understand which pages are visited and where visitors have difficulty, in aggregate.
- Advertising cookies and pixels may be set by advertising platforms to measure whether an ad led to a visit or an order, and to show our ads to people who have visited.
You can block or delete cookies in your browser settings, and most browsers let you refuse third-party cookies specifically. Blocking strictly necessary cookies may stop parts of the site working. We honor browser-based opt-out signals such as Global Privacy Control where applicable law requires it.
06Advertising and social media
We advertise on social media platforms, including Meta Platforms (Facebook and Instagram). Where those platforms provide measurement tools, they may collect information about your visit to this site — for example that a visit followed a click on one of our ads — and match it to their own records under their own privacy policies. We do not control their processing.
You can control much of this through the platform's own ad settings, including Meta's ad preferences and off-platform activity controls, and through the industry opt-out tools operated by the Digital Advertising Alliance and the Network Advertising Initiative.
Where our advertising is subject to political or issue advertising rules, the advertiser of record is American Proud of Patriots, and the contact information provided to the platform is the same as the contact information published on this site. We are an independent retailer and are not affiliated with any party, candidate or campaign; see our disclaimers.
07How we share information
- Service providers working on our behalf: payment processors, shipping and fulfilment carriers, email and website hosting providers, and accounting services. They may use the information only to provide services to us.
- Advertising and analytics platforms, as described in sections 5 and 6.
- Professional advisers such as accountants and lawyers, where necessary.
- Legal and safety disclosures, where we believe in good faith that disclosure is required by law, legal process or a governmental request, or is necessary to protect the rights, property or safety of our customers, our business or others.
- A successor business, if the business or its assets are sold, in which case this policy continues to apply to the transferred information until replaced with notice to you.
08Payment information
We do not collect or store full payment card numbers. Payments are processed by a third-party payment processor through a secure checkout or invoice link, and card details are submitted directly to that processor. We receive only confirmation of payment, the last four digits of the card, and the billing name and address.
09Data retention
We keep personal information only as long as we need it. Order and transaction records are retained for seven years to meet tax and accounting requirements. General correspondence is retained up to three years. Marketing email records are kept until you unsubscribe, after which we keep a minimal record of the unsubscribe so we do not email you again. Website analytics data is retained in aggregated form for up to twenty-six months. When information is no longer needed we delete it or aggregate it so it can no longer identify you.
10How we protect information
We use encrypted connections (HTTPS) on this site, access controls and strong authentication on the accounts holding customer information, and we limit access to the people who need it. No method of transmission or storage is completely secure and we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you and the relevant authorities where the law requires it.
11Your rights and choices
Depending on where you live, you may have the right to:
- Know what personal information we hold about you and request a copy.
- Correct information that is inaccurate or incomplete.
- Request deletion, subject to records we are required to keep.
- Ask us to limit or stop certain processing, including direct marketing.
- Receive your information in a portable, machine-readable format.
- Withdraw consent at any time, without affecting processing already carried out.
- Not be discriminated against for exercising any of these rights.
To exercise a right, email info@americanpeople.live with the subject line “Privacy request,” or call +1 (917) 310-4970. We respond within forty-five days and will tell you if we need more time. We may need to verify your identity, usually by confirming details of an order you placed. An authorized agent may submit a request with your written permission.
To stop marketing emails, use the unsubscribe link in any such email or write to us. You will still receive messages about orders you have placed.
12U.S. state privacy rights
Residents of California, Colorado, Connecticut, Virginia and other states with comprehensive privacy laws have the rights described in section 11, exercised the same way. We do not sell personal information, and we do not share it for cross-context behavioral advertising beyond the advertising controls described in section 6. We do not use personal information for automated decision-making that produces legal or similarly significant effects. If we deny a request you may appeal by replying to our decision, and we will respond to the appeal in writing.
13Children's privacy
This site and our products are intended for adults. We do not knowingly collect personal information from children under 13, and this site is not directed to them. If you believe a child has provided us with personal information, contact us and we will delete it promptly.
14International visitors
We operate in the United States and ship within the United States. If you visit this site from outside the U.S., your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.
15Third-party links
This site may link to other websites, including social platforms and payment processors. We are not responsible for their content or privacy practices, and we encourage you to read their policies before providing information to them.
16Changes to this policy
We may update this policy to reflect changes in our practices or the law. The date at the top of the page changes when we do. Material changes will be announced on this page, and where required by law we will provide notice by email. Continuing to use the site after a change takes effect means you accept the updated policy.
